  1. Chapter 1: General Provisions
    1. Article 1 (Purpose)
      1. The purpose of these terms of use is to stipulate the terms and procedures of all services provided by Digital Library of Korean Literature (hereinafter referred to as “Digital Library”) at Literature Translation Institute of Korea (hereinafter referred to as “LTI Korea”) as well as rights, duties, responsibilities and other general matters between users and Digital Library.
    2. Article 2 (Definitions)
    3. The terms used in these terms of use are defined as follows:
      1. 1. Users: Members and non-members who access the service and receive the services provided by the digital library.
      2. 2. Member: A person who agrees to these terms of use, provides personal information to register as a member, and has access to materials and services provided by the library.
      3. 3. Institutional member: A member who receives the institutional membership service provided by Digital Library.
      4. 4. User ID: A combination of alphanumeric characters or an e-mail address selected by the member and assigned by Digital Library for member identification and use of services. It is used to identify the use as a member.
      5. 5. Password: A unique combination of letters and numbers set by the user to protect the membership information
      6. 6. Service: Refers to the use of Digital Library and LTI Korea Library.
    4. Article 3 (Effectiveness and Modification)
      1. 1. These terms of use shall come into effect when they are disclosed to users through Digital Library.
      2. 2. These terms of us are subject to change without prior notice, and the revised terms of use shall be announced on the website of Digital Library or through e-mails to members. They take effect at immediately upon the dispatch of the notice. If the user does not agree to the revised terms of use, the user may cancel his/her membership registration (withdrawal of membership). Continued use of services shall be regarded as consent to the revised terms of use.
      3. 3. If necessary, Digital Library may set the terms of use and regulations for individual services (“service-specific information”), and in case of conflict with these terms of use, the contents of the service-specific information take precedence.
      4. 4. Matters not specified in this Agreement shall be governed by the Framework Act on Telecommunications, the Telecommunications Business Act, the Act on Promotion of Information and Communications Network Utilization and Information Protection, and other related laws.
  2. Chapter 2: Service Use Agreement
    1. Article 4 (Contract Formation)
      1. 1. The utilization contract is formed with the consent of LTI Korea to the application to use services of Digital Library submitted by a person who wishes to becomes a member and agrees to these terms of use.
      2. 1. In principle, the utilization contract provides one user ID per institutional member
    2. Article 5 (Approval and Rejection of Application)
      1. 1. When the application to use services is submitted after accurately specifying the matters set forth in Article 4, Digital Library shall approve the application to use services unless there are special circumstances.
      2. 2. Digital Library may restrict the use of some services in the following cases until the reason for the restriction is resolved.
        1. a) When an application is made using someone else's name or false information
        2. b) When it is deemed necessary by Digital Library
        3. c) In case of rejection, Digital Library must notify the applicant immediately upon rejecting the application.
    3. Article 6 (Withdrawal and Forfeiture of Membership)
      1. 1. Members may withdraw Digital Library at any time. Members who wish to withdraw membership must directly access My Page on the website of Digital Library and apply for withdrawal online.
      2. 2. When a member wishes to terminate utilization contract, he/she must return all borrowed items and apply for membership withdrawal. In case of long-term delinquency, the member information shall be retained for a certain period in accordance with the library operational regulations.
      3. 3. LTI Korea may restrict, suspend, or cancel the membership status without prior notice if the member falls under any of the following cases:
        1. a) When an application is made using someone else's name or false information.
        2. b) When a child under the age of 14 does not obtain the consent of a parent of a legal guardian.
        3. c) In case the application is made for the purpose of disturbing the social well-being or public morals.
        4. d) In the event of interfering with other users or stealing the information
        5. e) When the user commits an act prohibited by the laws and these terms of use while using the site.
        6. f) When other requirements for application for use prescribed by the digital library are insufficient;
    4. Article 7 (Modification of Contract Information)
    5. If the information provided at the time of submitting the application for use of services changes, the member must go to My Page on the website of Digital Library, and make changes online.
  3. Chapter 3: Provision and Use of Services
    1. Article 8 (Service Provision)
      1. 1. In the case of membership services, Digital Library shall start providing the services upon the approval of the application.
      2. 2. In principle, Digital Library’s services shall be made available at all times throughout the year. However, some services of Digital Library may be suspended for technical reasons, and the service provision may be temporarily suspended for a period set by Digital Library for operational purposes such as regular system inspection, expansion and replacement. In this case, Digital Library must notify the user in advance or afterward.
      3. 3. Digital Library may provide services to specific members as per request from the service provider, or divide services into different categories, and determine the availability of each category.
      4. 4. The closing dates of the translation library is announced through the website, and if necessary for operation, such as service reorganization, all or part of the service provision may be suspended after prior notice to the user.
      5. 5. The closes days of LTI Korea Library shall be announced on the website. For reasons necessary for operation, such as service reorganization, all or part of the service provision may be suspended with prior notice to the users.
      6. 6. In order to borrow books from LTI Korea Library and Digital Library, it is necessary to sign up for a membership of Digital Library first.
    2. Article 9 (Change · Suspension of Service and Storage · Use of Information)
      1. 1. The member agrees that Digital Library is not responsible for any loss of data, if the contents of messages stored or transmitted in the services or other communicative messages are not stored, deleted or sent due to a national emergency, power outage, service facility failure beyond the scope of Digital Library or other force majeure.
      2. 2. Given adequate reasons, Digital Library may modify or suspend all or part of the services provided for policy, operation and technical needs. Digital Library shall not provide separate compensation to users.
      3. 3. In case of change in the content, provision, and availability of the services, Digital Library must notify members of the change in advance. Digital Library is not responsible for the member's failure to perceive the notice during this period. The aforementioned notice period may be reduced or omitted for adequate reasons. In addition, Digital Library is not responsible for any loss of data or messages stored or transmitted in the services or other communicative messages due to the suspension as outlined above.
      4. 4. Paragraph 3 shall apply mutatis mutandis if the services must be permanently suspended due to the circumstances of Digital Library. However, in this case, prior notice must be provided one month in advance.
      5. 5. Digital Library may arbitrarily suspend the use of the services or prohibit the member's access in case of violation of the terms of use by the member, and may arbitrarily delete all or part of the contents posted by the member.
      6. 6. If the member does not agree to collection and use of personal information again within two years of signing up for a membership, the member’s personal information shall be deleted in stages as per the operational regulations of LTI Korea Library. In this case, the member may not re-register with the same member ID.
    3. Article 10 (Provision of Information)
      1. 1. Digital Library may provide members with information deemed necessary for using the services by e-mail, letter, SMS (text message), DM, messenger, etc. The member may refuse to receive unwanted information.
    4. Article 11 (Ownership of Digital Library)
      1. 1. Digital Library owns the services provided and the intellectual property rights and other rights related to software, images, marks, logos, designs, service names, information and trademarks required for the service provision.
      2. 2. Except for cases explicitly approved by Digital Library, the member shall not modify, lend, sell, distribute, produce, transfer, re-license, establish security rights for, or make commercial use of all or part of the property prescribed in Paragraph 1, or allow a third party to do so.
  4. Chapter 4: Obligations of Contracting Parties
    1. Article 12 (Responsibilities of Members and Information Security)
      1. 1. The member must provide accurate information based on facts when signing up for a membership or modifying membership information. If the membership is registered using someone else’s information or false information, the member may not claim rights related thereto.
      2. 2. The member shall comply with relevant laws and regulations, user guidelines, precautions, and notices as announced by Digital Library. The member must not engage in any act that interferes with the library's operation or damages the library's reputation, or harms others when using the library.
      3. 3. Once the member completes the registration process for using the services, he or she shall receive an ID and password. In case of change, the member must update membership information via Digital Library My Page without delay.
        4. The member is wholly responsible for management of the member ID and password.
      4. 5. The member must prevent leakage or theft of the member ID and password by third parties.
      5. 6. When the member ID or password is used illegally, the member must notify
        Digital Library without fail, and follow the instructions given by Digital Library.
      6. 7. Digital Library is not responsible for any disadvantages caused by the member’s failure to notify Digital Library of the matters outlined in Paragraph 6.
    2. Article 13 (Responsibilities of Digital Library)
      1. 1. Unless there are special circumstances, Digital Library must ensure that the services are available for the member from the designated start date.
      2. 2. Digital Library has the obligation to provide continuous and reliable services as outlined in these terms of use. However, Digital Library is not responsible for any loss of personal information due to unavoidable circumstances.
      3. 3. Digital Library shall promptly deal with opinions or complaints raised by members if they are deemed justified. However, if it is impossible to take immediate action, Digital Library must notify the member of the reason and the processing schedule.
      4. 4. In accordance with relevant laws and regulations, Digital Library shall endeavor to protect the member’s personal information, including the membership registration information. With regards to the protection of the member’s personal, Digital Library shall comply with the relevant laws and regulations as well as the terms outlined in Article 14.
    3. Article 14 (Personal Information Protection Policy)
      1. 1. Digital Library collects personal information as provided by the member at the time of membership application. The member’s personal information is used only for the purpose of fulfilling implementing this contract, and providing services under this contract.
      2. 2. Digital Library shall not divulge or distribute the member’s personal information acquired in connection with the provision of services to third parties without the member’s consent. Digital Library shall not use the member’s personal information for commercial purposes except in the following cases:
        1. a) Where there is a request for provision of information from a relevant institution for investigative purposes under relevant statutes.
        2. b) Where it is necessary for information protection, which includes the task of checking for fraudulent acts like violations of laws or terms,
        3. c) Where there is a request to provide information from a related agency for investigation purposes in accordance with related laws.
        4. d) When there is a request in accordance with the procedures stipulated.
  5. Chapter 5: Termination of Contract
    1. Article 15 (Termination of Contract and Restriction on Use)
      1. 1. When the member wishes to terminate the contract, the member must apply for termination on the website using the Internet.
      2. 2. Digital Library may request change of or change the member ID and password for reasons such as security, ID policy, and smooth provision of services.
      3. 3. Digital Library may terminate the contract without prior notice if the member commits any of the following acts:
        1. a) Providing false information or stealing another person’s member ID, password or personal information.
        2. b) Transmitting, posting, or disseminating via email or other means vulgar and obscene content or information that may infringe on the honor or privacy of others in violation of public order and customs.
        3. c) Harassing or intimidating others when using the library or continuously causing pain or inconvenience to a specific person.
        4. d) Stealing another person's service ID, password, or other personal information, or trading or providing a member ID;
        5. e) Copying, publishing, broadcasting, or providing to third parties information obtained through the services for purposes other than the use of the service without prior consent of the library.
        6. f) Violates other relevant statutes or the terms of use prescribed by Digital Library.
        7. g) The member may file an objection to the restriction on use under this clause in accordance with the procedures prescribed by the library, and if deemed justifiable, the use of services will be resumed immediately.
  6. Chapter 6: Compensation for Damages, etc.
    1. Article 16 (Compensation for Damages)
      1. Digital Library shall not be responsible for any damage incurred to members in connection to the services provided free of charge, except in cases where the damage is caused by Digital Library’s gross negligence or intentional act.
    2. Article 17 (Exemption clause)
      1. 1. Digital Library is exempted from responsibility for the provision of services if it is unable to provide services due to natural disasters or force majeure equivalent thereto.
      2. 2. Digital Library is exempted from liability for damage caused by unavoidable reasons such as maintenance, replacement, inspection, and construction of service facilities.
      3. 3. Digital Library is not responsible for any disruption in the use of services due to reasons attributable to the member.
      4. 4. Digital Library is not responsible for the profits that the member expects to gain by using the services or for any damage caused by the data obtained through the services.
      5. 5. Digital Library is not responsible for the reliability and accuracy of information, data, and facts posted by members on the service. Digital Library is not obliged to intervene in disputes between members or members and third parties via the service, nor is it liable to compensate for damages resulting therefrom.
    3. Article 18 (Competent Court)
      1. 1. If a lawsuit is filed despite all efforts towards amicable resolution with regards to a dispute arising from the use of the services, the court having jurisdiction over the location of Digital Library shall be the competent court.
  7. Chapter 7: Miscellaneous
    1. Article 19 (Prohibition of Transfer)
      1. The member shall not transfer or bequeath the right to use the services or the status as designated in the contract of use to another person, or provide them as security.

Addendum:

These terms of use take effect on May 9, 2022, and thus replace all matters applied to the previous terms of use.

  1. Literature Translation Institute of Korea (hereinafter referred to as “LTI Korea”) collects the minimum personal information required in order to provide optimal service. LTI Korea abides by the Personal Information Protection Act (PIPA) and takes appropriate measures to request the user’s consent to collection and use of personal information. Please read the information below carefully before you decide whether or not to give your consent.

  2. Outsourcing of Personal Information
